OUR POLICIES ABOUT UNSOLICITED EMAIL(SPAM)

What is Spam?

Spam is unsolicited, bulk email that hasn't been requested by the recipient. Spam is the opposite of permission-based email, which is normally anticipated, personal, relevant and/or associated with a pre-existing business or personal relationship. Newsgroup cross-posting and excessive posting of the same materials to several newsgroups, is also deemed as spam.

 

Preventing Spam

Customers of MarJac Enterprises products and services have agreed during their registration process, upon accepting the Terms of Use (see section 6(d)), to comply with this Anti-Spam Policy. Specifically, each customer agrees not to use the MarJac Enterprises products or services to send unsolicited email or bulk email, whether or not for commercial purposes. MarJac Enterprises reserves the right to determine in its sole discretion what constitutes spam, as well as what measures are necessary in response to such spam activities.

 

How MarJac Enterprises Avoids Spamming

MarJac Enterprises has deployed Internet marketing tools that only use strict permission-based e-mail marketing and is Implemented through the following:

(a) Communication and Agreement - The Terms of Use that our customers have agreed to as part of registering for the MarJac Enterprises products and services states that they are NOT allowed to collect visitor names, addresses, or any personal information, and that they will follow the MarJac Enterprises Privacy Policy and Anti-Spam Policy.

(b) Unsubscription - Each email created using MarJac Enterprises products contains an "unsubscribe link". This excludes the WRAP workshop coachmail that is an integral part of our customer's paid service. If our customer unsubscribes, they will be removed from the customer list that they originally subscribed to.

(c) Purchased Mailing Lists - MarJac Enterprises does not use or allow the use of purchased email lists. MarJac Enterprises only allows opt-in mailing lists. We will not use any email list relating to a particular subject matter for mailing unrelated topics

 

Laws Restricting Spam

Spam laws vary from state to state, and from country to country. This MarJac Enterprises Anti-Spam Policy has been developed to conform to the highest commercially reasonable standards. As a result, and without limiting the general prohibitions against all spam activities, MarJac Enterprises does not:

(a) Use false headers, or other false information, to identify the point of origin or the transmission path of the email, or to hide the true origin of the email sender.

(b) Use unauthorized third party's internet domain name without the permission of such third party, to make it appear that the third party was the point of origin of the email.

(c) Use of any false or misleading information in the subject line of the email.

(d) Assist any person in using the products or services of MarJac Enterprises for any of the previously mentioned activities.

 

Measures to Enforce the Anti-Spam Policy

Anyone found to be using MarJac Enterprises products or services for spamming purposes may, at MarJac Enterprises' discretion, be immediately cut off from use of all MarJac Enterprises products and services and/or fined US$ 1,000 per occurrence, with no refund of fees that have been paid. MarJac Enterprises warns all of its customers when signing up that if they participate in spamming activities they will be subject to the loss of MarJac Enterprises services, fines and possible legal action.

 

Reporting Spam

If the customer believes that they have received spam from or through MarJac Enterprises' facilities, they may send a complaint from their email account along with the unsolicited email, with the completed header, to abuse@relationship-in-crisis.com. Please provide any other information that you believe may help us in our investigation. MarJac Enterprises does not investigate or take any action based on "anonymous" spam complaints.

 

False Spam Complaints

If an individual has opted-in to receive email from MarJac Enterprises, and then falsely or maliciously files a spam complaint against MarJac Enterprises, We will cooperate fully with the appropriate agencies to ban the complainant from use of anti-spam software and the Internet community.

 

Updates

MarJac Enterprises uses only permission-based email marketing practices, and has established a no-tolerance, Anti-Spam Policy. MarJac Enterprises may update this Anti-Spam Policy without notice.
